Introduction

In April 2023, Dr Michael Schaper’s independent review of the Motor Vehicle Insurance and Repair Industry (MVIRI) Code of Conduct recommended a rewrite to enhance governance, compliance, dispute resolution, and accessibility.

The Code Administration Committee (CAC), consisting of representatives from the Insurance Council of Australia and the Motor Trades Association of Australia, has collaborated with industry stakeholders to develop a robust consultation draft. Consultation is now open on the updated Code.

Code of Conduct Review

The updated Code aims to improve clarity, fairness, and effectiveness in several critical areas, including:

Governance structure
Strengthening oversight and accountability

Sanctions & penalties
Introducing clearer consequences for non-compliance
Assessment times
Establishing transparent timelines for vehicle assessments
Methods of repair
Ensuring fair and consistent repair practices
